About Trademarks:

It's possible to register a name, logo, slogan, domain name, shape, colour or even a sound as a trademark. This protects any sign or symbol that allows customers differentiate between companies.

To be registered, a trade mark must be:

  • Not similar or identical to other marks for the same or similar goods and services
  • Distinctive for the goods and services you apply for.
  • Not deceptive, or contrary to law.

    A registered trademark:

  • Discourages people from using your trade mark without permission.
  • Allows you to take legal action against anyone who uses your trade mark without your permission
  • Means anyone who copies a trademark can be criminally charged by Trading Standards Officers or Police.
  • Becomes your property. You can sell it, or let other people have a licence that allows them to use it.
